Welcome to Calimetrics (“Calimetrics,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Calimetrics website at calimetrics.app, any related mobile application, features, content, and services we provide (collectively, the “Service”).
By accessing or using the Service, or by creating an account, you agree to be bound by these Terms.
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you represent that you have permission from a parent or legal guardian to use the Service. If applicable law requires parental or tutor consent for certain data processing activities, you agree that such consent has been obtained before using the Service.
To access certain features, you may be required to create an account using an email address and password or by signing in through a third-party login provider such as Google, Facebook, or Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Certain features of the Service may require a paid subscription. If you purchase a subscription through our website, payment processing is handled by Stripe, and we do not store your full payment card number.
If we later offer subscriptions through the Apple App Store or Google Play, those purchases may also be subject to the applicable platform’s billing, cancellation, and refund rules.
Subscriptions may renew automatically unless canceled before the end of the current billing period. You may cancel at any time through your account settings or through the platform where you purchased the subscription. Except where required by law or by applicable app marketplace rules, subscription fees are non-refundable and we do not provide refunds or credits for partial billing periods.
The Service allows you to enter, upload, and manage workout information, routines, logs, and related content (“User Content”). You retain ownership of your User Content.
You grant us a limited, non-exclusive, revocable license to host, store, process, and display your User Content solely as necessary to operate, maintain, and improve the Service for you.

Calimetrics is a fitness and workout tracking tool only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. You should consult a qualified healthcare professional before starting or changing any exercise, nutrition, or wellness program. Your use of the Service is at your own risk.
We may suspend or terminate your access to the Service if you violate these Terms, create risk for us or other users, or if we discontinue the Service. You may stop using the Service at any time.
Any provisions of these Terms that by their nature should survive termination will survive, including ownership, payment, disclaimers, limitation of liability, and governing law provisions.
The Service is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We do not guarantee that the Service will be uninterrupted, secure, error-free, or suitable for your particular goals or fitness outcomes.
To the maximum extent permitted by applicable law, Calimetrics and its affiliates, officers, directors, employees, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of the Service.
To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of: (a) the amount you paid us for the Service in the 12 months before the claim arose, or (b) CAD $100.
We may modify the Service or these Terms from time to time. If we make material changes, we will post the updated Terms and update the “Last Updated” date. Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.
